These terms govern your use of thecowboydrummer.com and any purchase you make through it. By using the site you agree to them. If you don’t agree, please don’t use the site.

Using the site

You agree not to:

  • Use the site for any unlawful purpose, or to break any applicable regulation.
  • Submit false, misleading or abusive content through any form on the site.
  • Attempt to gain unauthorised access to the site, its servers, or any connected system.
  • Use automated means to scrape, overload or interfere with the site or its services.

Orders and payment

All prices are shown in US dollars and exclude shipping and any applicable taxes, which are calculated at checkout. Payment is processed by Stripe; by placing an order you also agree to Stripe’s terms.

Merch is made to order through Printful. Placing an order is an offer to buy, which we accept when the order is confirmed for production. We may decline or cancel an order — including after it is placed — if an item is unavailable, a price or description was published in error, or we suspect fraud. If we cancel an order you have paid for, you will receive a full refund.

We try to describe products and show colours accurately, but screens vary and printed colours may differ slightly from what you see.

Tips and donations

Tips made through this site are voluntary contributions in support of Joe’s work. They are not tax-deductible charitable donations, and no goods or services are provided in exchange. Tips are generally non-refundable; if you tipped in error, get in touch and we will do our best to help.

Mailing list

Joining the mailing list is optional and you can unsubscribe at any time using the link in any email we send. See our Privacy Policy for how we handle your address.

Intellectual property

All content on this site — including the logos, artwork, designs, photography, text and the “Cowboy Drummer” name and marks — belongs to Joe Lana Jr. or its respective owners, and is protected by copyright and trademark law. Buying merch gives you the physical item; it does not transfer any rights in the artwork. You may not reproduce, resell or commercially exploit any of it without written permission.

Third-party links

The site links to third-party platforms such as YouTube, Instagram, Facebook and TikTok. We don’t control those services and aren’t responsible for their content or their privacy practices.

Disclaimers

The site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. We don’t warrant that the site will be uninterrupted or error-free.

Nothing in these terms excludes or limits liability where it would be unlawful to do so — including for death or personal injury caused by negligence, or for fraud.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some jurisdictions do not allow these limitations, in which case they apply to you only to the extent permitted.

Governing law

These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules.
